Terms of Service

These Terms of Service govern access to Nubis Salon websites, applications, online booking, point-of-sale software, and related services. By creating an account or using the service, you agree to these terms.

1. The service

Nubis Salon provides cloud-based tools for salon scheduling, online booking, customer management, point-of-sale, staff access, memberships, loyalty, gift cards, store credit, communications, reports, and related business operations. Features may vary by plan, platform, location, and availability.

2. Accounts and authorized users

• You must provide accurate account and business information.
• You are responsible for owner credentials, staff PINs, registered devices, roles, and permissions.
• You must promptly remove access for people who are no longer authorized.
• You are responsible for activity performed through your account unless caused by our failure to use reasonable security safeguards.

3. Acceptable use

You may not use Nubis Salon to:

• Break the law, violate another person's rights, or process information without proper authority.
• Attempt to bypass authentication, access another tenant, reverse engineer protected components, or interfere with service security.
• Upload malware, conduct abusive automated activity, or disrupt the service.
• Send unlawful, deceptive, or unsolicited communications.
• Use the service for high-risk activities for which it was not designed.

4. Salon data and privacy

You retain responsibility for the business, staff, and customer data entered into your account. You grant Nubis Salon permission to host, process, back up, transmit, and display that data as necessary to provide, secure, support, and improve the service. You must comply with applicable privacy and employment requirements.

5. Payments and subscriptions

Paid plans, taxes, billing intervals, trial periods, usage allowances, and additional-location charges are presented during registration, checkout, or plan selection. You authorize applicable charges using the selected payment method. Except where required by law or expressly stated otherwise, fees already charged are non-refundable.

6. Salon transactions

Salons are responsible for prices, taxes, discounts, refunds, memberships, loyalty rules, gift cards, customer disputes, and compliance with payment-provider requirements. Nubis Salon provides software tools but is not the salon, merchant of record, employer, or provider of salon services unless expressly stated.

7. Third-party services

The service may integrate with payment processors, email and SMS providers, maps, app stores, review services, printers, and other third parties. Their separate terms, fees, availability, and privacy practices apply. Nubis Salon is not responsible for third-party services outside our reasonable control.

8. Availability and changes

We work to provide a reliable service, but uninterrupted availability is not guaranteed. We may maintain, update, add, remove, or modify features for security, legal, operational, or product reasons. We will use reasonable efforts to communicate material changes that significantly affect paid customers.

9. Intellectual property

Nubis Salon and its software, branding, designs, documentation, and related materials are owned by Nubis Salon or its licensors and are protected by applicable intellectual-property laws. These terms grant a limited, non-exclusive, non-transferable right to use the service while your account remains authorized.

10. Suspension and termination

You may stop using the service and request account closure. We may suspend or terminate access for non-payment, serious security risk, unlawful activity, misuse, or material breach of these terms. Where practical, we will provide notice and an opportunity to correct the issue.

11. Disclaimers

To the extent permitted by law, the service is provided “as is” and “as available.” We do not guarantee that every feature will meet every business requirement or that the service will always be uninterrupted or error-free. You are responsible for reviewing transactions, reports, permissions, tax treatment, and business decisions.

12. Limitation of liability

To the extent permitted by law, Nubis Salon will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. Our aggregate liability relating to the service will not exceed the fees paid for the service during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply.

13. Changes to these terms

We may update these terms from time to time. Updated terms will be posted here with a revised date. Continued use after the effective date of updated terms constitutes acceptance, except where additional consent is required by law.
